Advanta account rates can be fixed rates, or they can be variable rates consisting of a Variable Rate Index combined with margins. Your account rate for Balance Transfers and Purchases will be Prime plus a Purchase Margin of 5.99% with an introductory 0% for the first twelve billing cycles from the date your account is opened. Your account rate for cash transactions will be either Prime plus a Cash Advance Margin of 5.99% or Prime plus a Cash Advance Margin of 11.74%, based on our assessment of your credit history and creditworthiness. Your Default rate can be either a fixed or a variable rate (see chart). Your Variable Rate Index for any billing cycle will be chosen by us from among the Prime Rates published in The Wall Street Journal 's "Money Rates" section during the three (3) months prior to the month which contains that cycle's Billing Cycle Closing Date, but will not be less than 8.25%. Any rate applicable to any component of your account, including any Default rate, will be applied throughout the entire billing cycle which contains the effective date of that rate, and will apply to previous balances as well as new transactions and charges.

Events of default are set out in the Advanta Business Card Agreement and include, among other things, not making payment so that it is received by its due date, paying less than the required amount, and being in default on any other account. Default rates, when imposed, replace other rates including introductory and promotional rates and apply to previous balances as well as to new transactions and charges.

Late Payment Fee varies based on the new balance: $19 on balances under $250; $39 on balances of $250 and over.

Overlimit Fee varies based on the new balance: $15 on balances under $501; $29 on balances between $501 and $1,001; and $39 on balances over $1,001.

Advanta Business Cards are issued by Advanta Bank Corp., Member FDIC, pursuant to Advanta Business Card Agreements. The Platinum BusinessCard is a MasterCard Executive BusinessCard. While the rates, indexes, margins, fees, and other account terms described here are typical of those recently offered and in effect on Advanta Business Cards and are expected to apply to your account, your account terms will be in every instance determined by us and reflected in your Card Agreement. Your Card Agreement also contains an arbitration provision, which replaces the right to have claims heard in court by a jury and also precludes participation in class actions. All of your account terms are subject to change. This means that your account rates, including any introductory or promotional rates offered, are not guaranteed; all account rates may be increased, fixed rates may change to variable rates, and variable rates may change to fixed rates. We may change your account terms (including rates) at any time for any reason. We may also change your account terms (including rates) if any Event of Default under your Card Agreement occurs. Events of Default include (among other things) failing to make any minimum payment due so that it is received by its due date, or exceeding your account credit limit, or making a payment to us that is not honored by your bank, or failing to make a required payment when due or otherwise being in default on any other account you have with us or any other creditor, or failing to keep your credit rating in good standing, or our concluding that you present a risk of future non-payment or the basis on which we determined your creditworthiness and eligibility for your account terms has changed. In determining any changes to your account terms (including rates), we may consider the length of time your account has been open; the extent, seriousness and timing of any Events of Default; and other factors relating to your account use and performance. All changes to your account terms (including rates) will be made in accordance with your Card Agreement, which you should read carefully and retain. We allocate your payments and credits to pay account balances bearing lower interest rates (such as introductory and promotional rate balances) before balances bearing higher interest rates.

Y our Request for Credit: The person (the "Signing Individual") whose name appears on an Advanta Bank Corp. ("ABC") credit application or invitation response (the "Application"), by submitting the Application, (1) represents that he/she is at least 18 years of age, a U.S. citizen or permanent legal U.S. resident, and either a proprietor or an authorized representative, partner, officer, employee or agent of the business identified in the Application (the "Business"); (2) agrees for him/herself individually and on behalf of the Business to be bound by the terms and conditions of the Advanta Business Card Agreement (the "Card Agreement") which, if and when issued, will be mailed with one or more requested credit cards (each, a "Card"); and (3) requests that ABC establish an Advanta Business Card account and issue Cards on the account to the Signing Individual and to each additional person (if any) for whom a Card is requested. The Signing Individual further acknowledges and agrees that: (i) all information provided in the Application or otherwise in connection with the request for credit is complete and correct; (ii) by using any Card or the account, the Signing Individual and the Business each agree to be bound by the terms of the Card Agreement; (iii) from time to time, ABC may verify any information provided in the Application or otherwise in connection with the request for credit, may investigate credit and order reports on the Signing Individual, the Business, and all persons for whom Cards are requested from credit reporting agencies and other appropriate sources, and may use this information, in addition to any business information which may be requested, to evaluate and approve the Application and determine the credit limit and any other terms for the account; (iv) ABC may answer inquiries from, and report to, credit reporting agencies and others relating to its receipt of and decision on the Application and its experience on the account; (v) ABC may exchange credit and other information from the Application and on the account, the Signing Individual, the Business and any other persons for whom Cards are requested or issued with its affiliates and/or third parties (including any co-brand vendor, service provider, affinity group or other person or entity who identified the Signing Individual, the Business, or any other such person to ABC as a customer, prospect, or member or in which membership is an ABC program benefit or who contacted you on ABC's behalf) unless it receives a written request at P.O. Box 30715, Salt Lake City, Utah 84130-0715 that it not do so; (vi) the Cards and the account will be used solely for business purposes (including commercial, industrial and professional purposes) and not for personal, family, or household purposes; (vii) the Signing Individual and the Business are jointly and severally liable for all transactions on the account (which means that the Signing Individual is personally liable for all amounts due ABC on the account); (viii) any person to whom a Card is issued is also personally liable for all transactions made with that Card; and (ix) to the extent not restricted or prohibited by applicable law, and whether or not ABC approves the Application, ABC may refer Application information to others for the purpose of offering credit and/or other products and services to applicants.

Any sample card or card art shown or included in any ABC credit solicitation is intended solely to illustrate how the recipient's customized Advanta Business Card could appear if and when issued, and is not an illustration of an actual credit card or an attempt by anyone to trade on the recipient's business name. If ABC offers you the opportunity to design your Card with a business name, design and/or logo, you represent and warrant to ABC that you are the lawful owner or licensee or user of that business name, design and/or logo and that you will indemnify ABC and its affiliates for any claim arising out of the use of that name, design and/or logo. You should consult your tax advisor as to the proper tax treatment and deductibility of any business expenses including the cost of credit. All rates and comparisons are valid as of October 20, 2006 but not necessarily thereafter.

ABC may withdraw or change the terms of this offer if it does not receive your completed application by the expiration date, or if it cannot confirm your identity or verify the information provided to it in the application or otherwise, or if it determines that you do not meet the criteria established for this offer, or if you already have a business account with ABC or its affiliates or have applied for or been considered for such an account within the previous 90 days, or if any person submitting the application or for whom a Card is requested is under the age of 18 or is not a U.S. citizen or a permanent legal U.S. resident.

Balance Transfers: ABC will transfer full or partial balances from other business accounts, in amounts up to $250 less than the amount of your total available ABC credit line, to your account, after it is approved, by processing your requests, in full or in part, in the order indicated. ABC determines your credit line as part of its application underwriting process, and that credit line may not be sufficient to accommodate all the balance transfers you request. (These transfer payments by ABC are the only "balance transfers" to which ABC's balance transfer account APRs apply.) You should continue making payments on those other accounts until ABC's transfer payments appear as credits on your other account statements. ABC cannot transfer balances from non-business accounts, and cannot close any accounts from which you have requested Balance Transfers, even if a requested transfer reduces an account balance to zero.
