Variable-Rate Information Your APRs may vary. For each billing cycle, we determine each APR by adding a margin to the prevailing U.S. Prime Rate. The margin for the Standard APR for Purchases and Balance Transfers is 5.99%; the margin for the Standard APR for non-online Direct Deposits and Check Cash Advances posted to your account either during the Promotional Period or before August 11, 2007 is 5.99% and the Standard APR for non-online Direct Deposits and Check Cash Advances posted to your account on or after August 11, 2007 and after the end of the Promotional Period is 15.99%; the margin for the Standard APR for Bank, ATM, and any other Cash Advances is 15.99%. Non-promotional Cash Equivalents posted to your account on or after August 11, 2007 will be Cash Advances and will be subject to the transaction fee for Cash Equivalents as noted below.

Late-payment fee: Based on your balance as of the day the fee is assessed- $15 if $100 or less; $29 if between $100.01 and $250; $39 if over $250. Over the credit limit fee: Based on your balance as of the day the fee is assessed - $15 if $500 or less; $29 if between $500.01 and $1000; $39 if over $1000. 1 Each time your minimum payment is late ( i.e. , not received by 5 p.m., ET, on its Payment Due Date), or the account balance is over-the-credit-limit, we may increase each of your account's Variable APRs up to the Default APR. The Default APR may be applied to all new and outstanding balances with Variable APRs then below the Default APR. If a Default APR is applied to your account, then all APRs, including APRS then at or above the Default APR, will no longer vary. 2 The U.S. Prime Rate used to determine your APRs for each billing cycle is the highest rate appearing in The Wall Street Journal on the last publication date of the calendar month that ends within that billing cycle. On March 30, 2007, the U.S. Prime Rate was 8.25%.If your account has balances with different APRs, payments are applied to the balance with the lowest APR before any payments are applied to balances with higher APRs. Efectiva Program Rules You will earn one Point for every one hundred dollars of net new monthly Purchases. Points will not be earned for Cash Advances or Promotional Balances. We may, at our discretion, include or exclude certain types of transactions from Point earnings at any time. Purchase credits issued by a merchant or by us will reduce your available Points. Points earned for charges you refuse to pay will be reversed. You can earn up to 600 Points each calendar year based on your monthly net purchases and balance transfers. When you transfer balances of $2,500 or more, you will earn 5 Points for every two thousand five hundred dollars transferred to your Bank of America Efectiva card per billing cycle. This applies to balances transferred at your contracted rate from non-Bank of America credit cards. Your monthly Bank of America Efectiva card statement will show your Point earnings, Point redemptions and new Point balance. Redemptions can also be made online at www.bankofamerica.com/efectiva You are not eligible to earn or redeem Points if: 1)You are in default of your Cardholder Agreement (e.g., if you do not make your Minimum Payment by the Payment Due Date); or 2)Your account is closed by you or Bank of America. When we receive your Reward requ est, we will review your Account to verify that your Point earnings are valid and that you have sufficient Points to receive the Reward. If you change or cancel a Reward you have requested, the Reward and redeemed Points may be forfeited. Expired Reward checks will not be replaced and Points will not be reinstated. Unredeemed Points have no cash or other value and cannot be transferred. Points do not constitute your property. Points are redeemed in increments of 25 (minimum 25 Points). There is no annual cap on Point redemption. Points earned in a calendar year will expire on December 31st of the fourth calendar year following the year during which the Points were earned.
