Cash Equivalents include the purchase of money orders, foreign currency, and travelers checks from a non-financial institution, person-to-person money transfers, bets, lottery tickets, casino gaming chips and, as of August 11, 2007, will include fines and bail bonds. Variable-Rate Information Your APRs may vary. For each billing cycle, we determine each APR by adding a margin to the prevailing U.S. Prime Rate. The margin for the Standard APR for Purchases and Balance Transfers is 9.99%; the margin for the Standard APR for non-online Direct Deposits and Check Cash Advances posted to your account either during the Promotional Period or before August 11, 2007 is 9.99% and the Standard APR for non-online Direct Deposits and Check Cash Advances posted to your account on or after August 11, 2007 and after the end of the Promotional Period is 15.99%; the margin for the Standard APR for Bank, ATM, and any other Cash Advances is 15.99%. Transaction fee for Purchases Transaction fee for the purchase of wire transfers from a non-financial institution: 3% of each such purchase (minimum $10). Non-promotional Cash Equivalents posted to your account on or after August 11, 2007 will be Cash Advances and will be subject to the transaction fee for Cash Equivalents as noted below.
Foreign Transactions Transaction fee for any transaction made in a foreign currency: 3% of the U.S. Dollar amount of each such transaction. This fee will be in addition to any other applicable fee.
Transaction fee for Balance Transfers and Check Cash Advances: None of each such cash advance (minimum $0 ). See 4 below for explanation. Transaction fee for Bank and ATM Cash Advances and online Direct Deposits: 3% of each such cash advance (minimum $10 ). Transaction fee for Overdraft Protection Bank Cash Advances (if enrolled): 3% of each such cash advance (minimum $10). Transaction fee for Cash Equivalents: 3% of each such cash advance (minimum $10). Late-payment fee: Based on your balance as of the day the fee is assessed- $15 if $100 or less; $29 if between $100.01 and $250; $39 if over $250. Over the credit limit fee: Based on your balance as of the day the fee is assessed - $15 if $500 or less; $29 if between $500.01 and $1000; $39 if over $1000. 1 Each time your minimum payment is late ( i.e. , not received by 5 p.m., ET, on its Payment Due Date), or the account balance is over-the-credit-limit, we may increase each of your account's Variable APRs up to the Default APR. The Default APR may be applied to all new and outstanding balances with Variable APRs then below the Default APR. If a Default APR is applied to your account, then all APRs, including APRS then at or above the Default APR, will no longer vary. 2 The U.S. Prime Rate used to determine your APRs for each billing cycle is the highest rate appearing in The Wall Street Journal on the last publication date of the calendar month that ends within that billing cycle. On March 30, 2007, the U.S. Prime Rate was 8.25%.If your account has balances with different APRs, payments are applied to the balance with the lowest APR before any payments are applied to balances with higher APRs. This means that balances with higher APRs are not reduced until balances with lower APRs have been paid off. 3 The Introductory APR is effective upon the opening of your account and does not apply to Bank and ATM Cash Advances, or online Direct Deposits. When a Promotional Period ends, the Standard Variable APR is calculated using the Variable-Rate Information and is applied to new and outstanding balances (consisting of Purchases, Balance Transfers, non-online Direct Deposits, and Check Cash Advances). PetRewards Program Rules These Program Terms and Conditions describe the rules that will apply to the rewards feature of your PetRewards Visa credit card. In these Program Terms and Conditions, "we," "us," and Bank of America shall mean Bank of America, N.A. (USA), the issuer of the PetRewards Visa Credit Card ("Rewards Card") and administrator of this rewards program. "You" shall mean the primary cardholder of the PetRewards Visa credit card account ("Account"). You will automatically earn points toward rewards by using your PetRewards Visa Card ("Program") as described here. Your participation in the Program is subject to the terms and conditions of these Program Terms and Conditions ("Rules"). By using your PetRewards Visa Account you agree to the terms of this Program. Hill’s Pet Nutrition, Inc. is the provider of the PetRewards Redemption Rewards. Please read and retain these Rules. Rewards Program Points. Under the Program, you will earn two (2) PetRewards Points for each dollar you spend in net retail purchases (purchases less credits, returns, and adjustments) at participating veterinary clinics, pet food retailers, farm and feed stores, and neighborhood pet specialty stores and one (1) PetRewards Point for each dollar you spend in net retail purchases using your PetRewards Card, including charges for Bank of America’s optional Cardholder Security Plan®. The maximum number of PetRewards Points that can be earned in a calendar year is 100,000; however, there is no limit to the number of PetRewards Points that can be redeemed within a year. From time to time, we may offer special rewards opportunities for limited time periods. Additional terms and conditions may apply to such programs. We will communicate special promotions on your monthly statement, at www.petrewards.bankofamerica.com, www.hillspet.com and/or via other communication vehicles. The PetRewards Points you earn will accrue monthly and appear on your monthly Account billing statement in the billing cycle in which they were earned. Your purchase amounts will be rounded up to the nearest whole dollar when we calculate the PetRewards Points earned. PetRewards Points will expire 36 cycles from the original billing period. PetRewards Points will be redeemed on a first in first out basis. PetRewards Points are not the property of the cardholder and cannot be bought, sold or transferred in any way (including upon death or as part of a domestic relations matter). PetRewards Points are not transferable or redeemable for cash and cannot be offset against any amount owed on your Account. PetRewards Points from multiple accounts cannot be combined. Bank of America reserves the right to increase or decrease, without notice, the points required for individual items; this right includes corrections due to printing errors. PetRewards Points are deducted for any purchase of goods or services which is returned (or otherwise the subject of a credit). PetRewards Points are deducted for any purchase of goods or services which becomes the subject of a dispute unless and until final resolution of the dispute results in a debit to your Account. No PetRewards Points will be earned, or points previously earned will be deducted, with respect to transactions made with lost, canceled, stolen or fraudulent Bank of America credit cards, draft checks, or accounts. In the event that an adjustment to your PetRewards Points total means that you received a reward that you were not otherwise entitled to under the Program, you agree to forfeit all future PetRewards Points earnings until such time as sufficient PetRewards Points are accrued to cover the reward. We have the right to change, suspend or terminate any or all rules or offers of this Program at any time. We also have the right to add, eliminate or modify any specific PetRewards Point award rates or levels. PetRewards Points will be forfeited if your account is in one of the following statuses: charged off, bankrupt, credit counseling, credit revoked or closed. PetRewards Point discrepancies must be brought to Bank of America’s attention promptly but in no event later than 60 days from the date of the transaction for which an adjustment is sought. Otherwise, PetRewards Points earned will be deemed accurate and you will have waived all claims for adjustment. PetRewards Point discrepancies do not constitute billing errors on your Account and payments on your Account are due as provided in your Cardholder Agreement.
Qualifying Purchases. Unless we specify otherwise, you will NOT earn PetRewards Points on: cash advances, convenience checks, balance transfers, finance charges, fees (including late-payment fees, over-limit fees, annual maintenance fees and returned check fees), payments, money order purchases, traveler’s cheques, over draft protection transactions, insurance charges , unauthorized charges, quasi-cash and ATM transactions. Any questions as to what constitutes an eligible charge shall be resolved at the sole discretion of Bank of America. You will NOT earn PetRewards Points on credits or returns to your Account and the PetRewards Points balance on your Account will be reduced by the amount of any credit or return. Participation in Program. If for 60 or more days your Account is delinquent, past due or over its credit limit, you will not earn additional PetRewards Points until your Account becomes current and in good standing. You will NOT receive retroactive PetRewards Points for charges on your Account that were made during such delinquent, past due or over limit period. Also, you will NOT earn PetRewards Points if you are in default of your Cardholder Agreement for any other reason, such as bankruptcy, charge-off, litigation involving your account, credit counseling, or your account is suspended for fraud or security reasons. Points Redemption. PetRewards Points may be redeemed by the primary cardholder for rewards via the online PetRewards site www.petrewards.bankofamerica.com or via telephone 1.800.746.8747 to the PetRewards Redemption Center. PetRewards Points will accrue as merchant transactions post to the Account. PetRewards Points will be available for redemption after the close of the billing cycle in which the purchases were made. In order to redeem PetRewards Points, your Account must be open and in good standing. This means we have not cancelled or closed your Account for any reason, you are not in default of your Cardholder Agreement and your Account is not 60 or more days delinquent, past due or over the credit limit. If any of these conditions exist, and your Account is later re-opened and in good standing, you may once again redeem any accrued PetRewards points. If you close your Account, you forfeit any previously accrued unused PetRewards Points on your Account the day your Account is closed. You may redeem only the available PetRewards Points that are displayed in the PetRewards Points Summary section of your most recent monthly Account billing statement. Award redemptions can be made through the PetRewards Redemption Center at 1.800.746.8747 Monday - Friday from 7am to 8pm CST and on Saturday from 9am to 5pm CST. Redemptions for merchandise and certificates can also be made online at www.petrewards.bankofamerica.com. Program Rewards. We reserve the right to substitute rewards with comparable rewards of equal or greater value and to discontinue any reward without advance notice. PetRewards and offers are void where prohibited by law. Information in the PetRewards website is accurate, to the best of our knowledge. Bank of America is not affiliated with any of the animal shelters, neighborhood pet specialty stores, farm and feed stores, or veterinary clinics. By redeeming PetRewards Points for any reward, you agree that Bank of America is not responsible for rewards provided by third parties and agree to release Bank of America, participating Program service providers, partners, sponsors and contributors, and each of the foregoing entities’ respective affiliates, subsidiaries and advertising and promotional agencies from any and all liability for injury, accident, loss, expense or damages sustained in connection with the receipt, ownership or use of any reward. Redeemed rewards cannot be returned, refunded, exchanged, or replaced for cash, points, or other rewards. By accepting any reward, you agree to permit Bank of America and/or Hill’s to use your name and a description of the reward for promotional or advertising purposes without further compensation to you. Redeemed rewards have no cash value. Rewards are not refundable or exchangeable. If a reward is to be mailed to the cardholder, the address on our billing records will be used. Please allow up to three weeks from the time you place your order for delivery of any reward, such as food discount coupons, veterinary rebate checks, and veterinary rebate forms. Upon request to redeem PetRewards Points for a reward, your account will be reviewed to verify that the PetRewards Point earnings are valid and that there are sufficient PetRewards Points for the requested reward. In the event of a credit or other adjustment that results in insufficient PetRewards Points for that reward, the reward will not be filled. If the reward order is fulfilled and Bank of America later discovers that the Cardholders did not have sufficient PetRewards Points for that reward, the Cardholders will forfeit all future PetRewards Points earnings until such time as sufficient PetRewards Points are accrued to cover the reward. Rewards printed from the PetRewards redemption website may not be reproduced. Bank of America reserves the right to disqualify any person and/or account from participation in the Program, refuse to award PetRewards Points, or close your Account if, in its sole judgment, you have or any other person using your Account has violated any of the terms, conditions, and/or purpose of the Account and/or Program, including that a reward (e.g., rebate) has been reproduced. Rewards are subject to terms and conditions of use. Rewards, once received by cardholders, will not be replaced if stolen, lost, destroyed or expired. Rewards may not be returned for refund of PetRewards Points. Refer to Reward for expiration dates. Rewards cannot be used in conjunction with any other offer, be applied as payment to any account, or be applied to any previous purchases. 5.1. Discount (Checks/Rebates) on Veterinary Services. PetRewards Points may be redeemed for veterinary rebates. A valid original veterinary visit receipt is required as proof of purchase when submitting the Veterinary Rebate redemption form. Once approved, a rebate check will be mailed to You. Your rebate should arrive within three weeks from the date the PetRewards redemption center receives your completed form and valid veterinary receipt. Veterinary rebates can not be combined with any other offer. 5.2. Animal Shelter Donations. Shelter donations can be made to participating shelters. You may access a list of participating shelters at www.petrewards.bankofamerica.com or by contacting the PetRewards Redemption Center at 1.800.746.8747 Monday - Friday from 7am to 8pm CST and on Saturday from 9am to 5pm CST. Shelter donations will be made on your behalf in the form of cash, pet food or other preferred goods and services as preferred by the shelter to the approved shelter of your choice. You will receive confirmation of your donation once the donation has been made to the shelter. Donations are not tax deductible. 5.3. Discounts on Pet Food. Only one coupon is allowed per purchase of Hill's Science Diet® or Prescription Diet® brand pet foods. Pet food coupons can not be combined with any other offer. Coupons may not be reproduced. Bank of America reserves the right to disqualify any person and/or account from participation in the Program, refuse to award or redeem points, or close your Account if, in its sole judgment, your Account is not in good standing, you have provided false information or you or any other person using your Account has violated any of the terms, conditions, and/or purpose of the Account and/or the Program, including but not limited to fraud, excessive transactions, or other abuse. Such disqualification may be temporary or permanent and result in the forfeiture of any accumulated points.
